1. Acceptance of Terms
By accessing or using the services provided by Gamelinkr - Gardening in Spain, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Gamelinkr - Gardening in Spain. If you do not agree to all these Terms, you are not authorized to use our services. Your continued use of the services signifies your acceptance of any revisions to these Terms.
We reserve the right to update or modify these Terms at any time without prior notice. It is your responsibility to review these Terms periodically for changes. Your continued use of the services after any modifications constitutes your acceptance of the revised Terms.
2. Services
Gamelinkr - Gardening in Spain provides a range of gardening and landscaping services tailored for the Spanish climate and environment. Our services include, but are not limited to, garden design, plant selection, installation, irrigation system setup, maintenance, pest control, and consultation. Specific details of services will be outlined in individual service agreements or project proposals.
We strive to deliver high-quality services using appropriate tools, materials, and expertise. However, the success of certain gardening endeavors can be influenced by external factors such as weather conditions, client care, and natural plant growth, which are beyond our direct control.
3. User Responsibilities
- You agree to provide accurate and complete information when engaging with our services, including site access, specific requirements, and any relevant property details.
- You are responsible for ensuring a safe working environment for our staff while on your property.
- You must comply with all applicable local laws, regulations, and ordinances related to your property and the services rendered.
- For ongoing maintenance services, you are responsible for adhering to any recommended care instructions provided by Gamelinkr - Gardening in Spain to ensure the health and longevity of your garden.
- Any changes or additions to the agreed-upon services must be communicated and approved in writing.
4. Payment and Billing
Payment terms will be specified in the individual service agreement or project proposal. Unless otherwise agreed, a deposit may be required before commencement of work. Invoices are due upon receipt or as per the agreed payment schedule.
Late payments may incur interest and/or administrative fees as permitted by law. In the event of non-payment, Gamelinkr - Gardening in Spain reserves the right to suspend or terminate services and pursue legal remedies for outstanding amounts.
All prices quoted are in Euros (€) unless otherwise stated and do not include applicable taxes, which will be added to the invoice where required by law.
5. Intellectual Property
All content, designs, plans, and materials created or provided by Gamelinkr - Gardening in Spain as part of its services, including but not limited to garden designs, plant lists, and horticultural advice, remain the intellectual property of Gamelinkr - Gardening in Spain until full payment for the services has been received. Upon full payment, the client is granted a non-exclusive, non-transferable license to use such designs and materials for the specific property for which they were created.
You agree not to reproduce, distribute, modify, or create derivative works from any content or materials provided by Gamelinkr - Gardening in Spain without explicit written permission.
6. Limitation of Liability
Gamelinkr - Gardening in Spain will perform its services with reasonable care and skill. However, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; (c) any content obtained from the services; and (d) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Our total liability to you for any and all claims arising out of or relating to these Terms or your use of the services, whether in contract, tort, or otherwise, shall not exceed the amount paid by you to Gamelinkr - Gardening in Spain for the specific services giving rise to the claim.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Spain.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the services.
